TERMS OF SERVICE

Last Update: June 2026

Madeira Quest is a brand dedicated to creating and promoting outdoor experiences based on challenges, puzzles, and walking routes. The Madeira Quest experience is promoted and operated by the responsible entity identified during the booking process. Use, purchase, or participation in the Madeira Quest experience implies full acceptance of these Terms and Conditions.

By making a reservation, the Client declares having read, understood, and accepted these Terms and Conditions, which apply to participation in and the purchase of the Madeira Quest experience.

By purchasing or participating in the Madeira Quest experience, promoted by Madeira Quest, you agree to be bound by the Terms and Conditions specified in this document.

The experience takes place in a public space and entails accepting the risks inherent in moving through and interacting with the environment; consequently, each participant is responsible for their own behavior, safety, physical well-being, and belongings.

All participants commit to adopting responsible behavior and respecting others, public spaces, private property, and traffic rules—including road signs and instructions from authorities—with it being expressly prohibited to endanger their own safety or that of others.

Participants commit to complying with all applicable legal standards and traffic rules—including road signs and instructions from authorities—and to maintaining responsible behavior appropriate to the surrounding environment throughout the entire experience.

Madeira Quest accepts no liability for personal injury, accidents, loss, or damage resulting from participation—except as provided by law—nor for incorrect interpretations of the materials provided or failure by participants to follow instructions.

Madeira Quest strives to ensure the quality and accuracy of the materials and content provided. However, it accepts no liability for any errors, omissions, or misinterpretations on the part of participants during the experiment. Participation implies the proper use of the provided materials in accordance with the instructions.

All content, materials, challenges, graphic elements, texts, narratives, and other components associated with Madeira Quest constitute the project's intellectual property and may not be modified, copied, reproduced, distributed, transmitted, published, licensed, sold, or used without prior written authorization.

It is expressly prohibited to use the experience promoted by Madeira Quest, its website, or any element associated with the experience for illegal, fraudulent, defamatory, harmful, or offensive purposes, or for purposes contrary to applicable law.

The materials provided—including kits, backpacks, locks, and other equipment for the experiment organized by Madeira Quest—must be used with care and responsibility. Some kits or materials may contain tracking devices intended solely for the protection, recovery, and operational management of project-owned equipment; these are not used to monitor participants or to collect personal data for commercial or surveillance purposes. All materials made available for the experiment remain the property of Madeira Quest and must be returned at the end of the activity in the same condition as received, barring normal wear and tear resulting from proper use. Failure to return the materials, or returning them with damage exceeding normal wear and tear, may result in charges for the associated replacement or repair costs. Madeira Quest reserves the right to claim compensation for damage caused by the improper, negligent, or intentional misuse of materials.

Participants are responsible for their personal belongings throughout the experience. The use of mobile phones and other devices is permitted, provided it is done responsibly and without disrupting the flow of the experience. Madeira Quest accepts no liability for the loss of, damage to, or misplacement of personal items during the activity. The experience is designed to be immersive; therefore, limited use of electronic devices is recommended, except when necessary.

Participation assumes that participants are in suitable physical health; assessing one's own fitness prior to the activity is the sole responsibility of the participant. Madeira Quest cannot be held liable for individual limitations, medical conditions, or health issues that affect participation.

Participants agree to comply with all instructions provided by the Madeira Quest team and not to participate in the experience while under the influence of alcohol or substances that could compromise safety. Madeira Quest may refuse, interrupt, or terminate participation in the event of inappropriate or dangerous behavior, non-compliance with instructions, or circumstances that jeopardize the safety of participants, the team, or third parties. In such cases, and whenever there is legitimate cause, no refund will be issued.

Participants agree not to carry or use any dangerous objects during the experience. Madeira Quest reserves the right to refuse or interrupt participation if it determines that conditions exist which could compromise the safety of participants or third parties, or the proper conduct of the activity.

Madeira Quest shall not be held liable for any direct, indirect, incidental, or consequential damages arising from participation in the experience—including financial losses, loss of opportunity, business interruptions, loss of data, or any other damages resulting from external circumstances, misuse of the experience, or failure to comply with these Terms and Conditions—except to the extent permitted by law.

The Madeira Quest experience is covered by civil liability insurance arranged by the organizing entity, in accordance with the legal requirements applicable to the activity. This insurance is intended exclusively to cover damages that, under the law and the terms of the respective policy, are attributable to the entity responsible for organizing the experience. The insurance does not cover damages resulting from failure to follow provided instructions, misuse of materials, or negligent or reckless behavior by participants, nor does it cover the loss of or damage to personal belongings.

Civil liability insurance does not constitute personal accident insurance; therefore, each participant is responsible for ensuring they are physically fit to undertake the activity and for adopting behaviors appropriate to their own safety. Additional information regarding the insurance may be provided to participants upon request.

Participants must arrive at the designated location at the recommended time. Delays may reduce the time available for the experience, and significant delays may be treated as a "no-show," with no entitlement to a refund. The duration of the experience is approximate and depends on the group's pace. Madeira Quest reserves the right to conclude the activity at the end of the scheduled operating period for the booking.

Madeira Quest reserves the right to alter, substitute, adapt, or temporarily remove parts of the route, challenges, materials, or elements of the experience whenever justified by operational circumstances, safety requirements, maintenance, public works, external events, or factors beyond the project's control.

The contact information provided by Madeira Quest during the experience is intended exclusively for operational support, emergencies, or the provision of activity-related clues, and must be used responsibly and appropriately.

Madeira Quest takes appropriate measures to protect information provided by users during the booking and payment process; however, as data transmission over the Internet is not entirely secure, Madeira Quest cannot guarantee the absolute security of communications nor be held liable for unauthorized access, data loss, or other situations resulting from vulnerabilities external to its systems. Personal data is processed in accordance with the GDPR and applicable Portuguese legislation, as outlined in the Privacy Policy available on the website.

Minors may participate subject to authorization from their parents or legal guardians. Minors under the age of 18 (eighteen) must be accompanied by at least one adult aged 18 (eighteen) or older.

Those accompanying minors are solely responsible for their supervision, safety, and behavior throughout the experience.

All participants, regardless of age, must be included in the booking for organizational, safety, and capacity purposes.

Taking photos and videos during the experience is permitted and encouraged. Participants are encouraged to share their experience on social media, tagging Madeira Quest’s social media accounts whenever possible. However, participants agree not to disclose, share, or make public any content that reveals solutions, puzzles, or key elements of the experience, in order to preserve the experience for future participants.

Trademarks, logos, visual elements, and other distinctive signs associated with Madeira Quest are the exclusive property of the project and are protected by applicable intellectual property laws.

Participants acknowledge that puzzles, challenges, narratives, game mechanics, and other elements of the experience constitute content protected by intellectual property rights and trade secret laws.

Participants agree not to disclose, reproduce, publish, or share—in whole or in part—any solutions, puzzles, materials, or internal information regarding the experience that could compromise the integrity of Madeira Quest or spoil the experience for future participants.

The use, reproduction, distribution, or exploitation of any Madeira Quest identifying elements without prior written authorization is expressly prohibited and may constitute an infringement of the respective intellectual property rights.

Madeira Quest reserves the right to modify these Terms and Conditions whenever necessary. Any changes will be published on the website, and it is the Customer's responsibility to review them before making a booking or participating in the experience.

Madeira Quest makes every effort to ensure that the information provided on the website and during the experience is clear, up-to-date, and accurate. In the event of a conflict between promotional information and these Terms and Conditions, the provisions of this document shall prevail.

Madeira Quest reserves the right to interrupt or terminate the experience at any time in the event of inappropriate, dangerous, or abusive behavior, or conduct contrary to instructions provided by the team, as well as in situations that jeopardize the safety of participants, staff, or third parties. In the aforementioned cases, and whenever there is a legitimate reason for interrupting the experience, Madeira Quest reserves the right not to issue any refund.

Madeira Quest does not tolerate any form of harassment, discrimination, or abusive, aggressive, or inappropriate behavior toward participants, staff, partners, or third parties involved in the experience.

It is the Client's responsibility to verify and confirm all booking details prior to submission and payment.

Requests for cancellation or rescheduling must be made via the official contact channels provided by Madeira Quest—specifically, using the details found in the booking confirmation email.

Booking errors, delays, no-shows, or failure to comply with previously communicated conditions may result in the forfeiture of any refund; such cases will be assessed at the discretion of the Madeira Quest team and in accordance with current cancellation and rescheduling policies.

Pursuant to Article 17, paragraph (l) of Decree-Law No. 24/2014, the Customer acknowledges that there is no right of free withdrawal, as the service involves a leisure activity taking place in a public space at a specific date and time.

By purchasing the experience offered by Madeira Quest, the Customer acknowledges that the activity takes place outdoors and may be subject to weather conditions and other external factors beyond the team's control.

Reservations may be cancelled free of charge up to two hours before the scheduled time. Cancellations made with less than two hours' notice, significant delays, or failure to appear ("no-show") do not entitle the customer to a refund.

Rescheduling requests are subject to availability. The Customer agrees that, should extreme weather conditions, safety concerns, or exceptional circumstances make it impossible to conduct the experience, rescheduling or another appropriate solution may be proposed.

Promotional campaigns, discounts, or special offers provided by Madeira Quest may be subject to specific terms of use, expiration dates, usage limits, and eligibility rules.

Madeira Quest reserves the right to modify, suspend, or cancel promotional campaigns at any time, without prejudice to the rights legally applicable to reservations that have already been confirmed.

Unless otherwise stated, discounts and promotional offers cannot be combined and do not apply retroactively once a booking is finalized.

The Customer is responsible for providing accurate, truthful, complete, and up-to-date information at the time of booking and agrees to provide advance notice of any physical conditions, mobility limitations, or other relevant circumstances that could affect safe participation in the experience.

Madeira Quest recommends that participants avoid carrying or using items, food, or beverages that could damage the experience's equipment, compromise participant safety, or interfere with the normal operation of the activity.

While children are permitted to participate, Madeira Quest recommends that participants be of an age and capability suitable for understanding the challenges, movement requirements, and dynamics of the experience.

All participants agree to act with prudence, responsibility, and respect for the instructions provided by the team in charge of the experiment, adopting the necessary measures for their own safety and the safety of other participants and third parties.

In the event of a dispute, the consumer may turn to the competent consumer dispute arbitration center or the Electronic Complaints Book. Pursuant to Law No. 144/2015 of September 8, consumers are informed that they may have recourse to the competent consumer dispute arbitration center, available at www.consumidor.gov.pt.

These Terms and Conditions, as well as any contractual relationship established with Madeira Quest, are governed by applicable Portuguese law.

Participation in the experience implies knowledge, understanding, and full acceptance of these Terms and Conditions.

In the event of any discrepancy in the linguistic interpretation of any provision contained in these Terms and Conditions, the Portuguese version shall prevail.
